Has The UK Gone Compensation Crazy?

It is being hailed as an American trend that has taken off in the UK, much to the dismay of many.Compensation claims are being made for all types for reasons by all types of people. Is this unreasonable and why do people claim it if its not purely for financial gain?

Well, much depends on the extent of what has happened, the hardship it has caused and whether or not someone else is at fault. Many claim that the compensation culture has gone too far because claims are being made for trivial reasons where people need to take responsibility for their own actions but, instead, prefer to do things mindlessly and then make a compensation claim if something goes wrong.

There are occasions where people simply do not apply common sense and this leads to all manner of problems that they then try to make compensation claims for. This has led to all products being sold with idiot proof instructions on how they should be used. This covers the manufacturer against any future claims.

However, there are many more serious issues at stake and ones which nothing short of a decent compensation payout would cover. We may think the advert of the woman slipping on spilt water is silly but if that were you, if someone had spilt the water and not bothered to clean up, if you had slipped on it and injured yourself, who would pay your utility bills or your food bills or your mortgage whilst you were off work for months, recovering?

These are the questions that bring many people to the decision to make a compensation claim.Accidents and injuries cause people to need time off work and not everyone is covered by insurance that allows them to do this, whilst still being able to maintain a home and family.

There are, of course, many occasions where human error brings a person to claim compensation. For example, in a hospital, where we put our lives in the hands of the doctors, there really is no room for mistakes.Yet, for whatever reason, it still happens.A woman in hospital died after being given penicillin by doctors even though her medical notes clearly stated she was allergic to it.

Because this was an obvious error by the administering doctor, the family are entitled to claim compensation. This is less about the money and more about apportioning blame. This is often a sticking point for families in the course of their grieving. If you know someone's mistake has caused the loss of a loved one then of course you want them to answer for it and also to provide answers as to why it happened.

Everybody knows that mistakes are made, that accidents happen, yet hospitals, particularly in the Western world, should be far enough advanced these days so as to ensure that medication and procedures are checked time and time again to avoid this sort of tragedy. It is too late for the woman and her family but if the hospital is made to answer for the actions of the doctor then maybe the action will make them more astute in the future and prevent a further occurrence.

Until a different method can be found, compensation claims will continue to be made so that answers can be provided and people can get by whilst sick or injured through somebody else's negligence or lack of thought.
